Current projects

Business Asset Protection works with both lenders and borrowers.  We understand the pressures faced by each.

For our lender clients we are currently working on traditional debt collection matters as well as more exotic transactions.

  • DCPLH v Kesinda – here we are the assignees of a number of parties previously holding debts.  There is a sum of money held on trust by the NSW Supreme Court.  We are presently preparing filings stating our claim/s to the funds.  This matter involves a priorities dispute.  See blog page – tba.  
  • DCPLH v Bargo Developments Pty Ltd (in liquidation).  Here we are the assignee of 3 creditors to the company.  See blog page – tba.  
  • DCPLH v Golden Arrow International Pty Ltd (in liquidation).  Here we are the assignee of a large creditor to the company.  See blog page – tba.  
  • DCPLH v JM (we can’t mention the name of the defendant here however the matter involves a professional negligence claim).  See blog page – tba.  
  • DCPLH v the Estate of Elias Azzam (2 matters).  In matter 1 we are considering an insolvent trading claim.  In matter 2 we are, as assignee, seeking equitable contribution from the estate of the co-surety to various mortgages.  See blog page – tba.  
  • DCPLH v the Director General of NSW Land & Property Information (2 matters).  These are claims being considered against the NSW Torrens Assurance Fund.  See blog page – tba.  
  • DCPLH v CC (we can’t mention the name of the defendant here however the matter here involves commercial arbitration of a cross-border dispute). See blog page – tba.  
  • DCPLH v AS (we can’t mention the name of the defendant here however the matter involves a professional negligence claim).  See blog page – tba.

  • POE v guarantors of HKJS Holdings – we have been working for a number of months with one of our clients on a loan enforcement matter.  We obtained a court judgment in the District Court of NSW, advised on the appointment of receivers and assisted in refinancing.  This matter continues as a current project with a different scope of enforcing the loan against its guarantors now that the refinancing that was put up has been further breached. 
  • many other matters.
